Official Contest Rules and Prizes

To provide fair and equal chance of winning to all, the following are the Official Rules for the Cambria Instagram Contest. Cambria reserves the right to change these rules in order to, in its sole discretion, secure the proper administration of the Contest and fairness in judging. Participation in the Contest constitutes full and unconditional agreement to, and acceptance of, these Official Rules. CONTEST PERIOD

The contest starts on December 6, 2012 at 12:00:01 AM Central Standard Time (“CST”) and closes on April 6, 2012 at 11:59:59 PM CST.

HOW TO ENTER

“Instagram your favorite memory to win an iPhone 5!”

To enter, participants will be directed to follow Cambria on Instagram at @CambriaQuartz. Participants must upload a photo of their favorite memory and tag @CambriaQuartz and #CambriaStyle for official entry.

WINNERS

WINNERS: Two (2) winners will each receive an iPhone 5 (approximate retail value $699.99 USD). The first winner (1) will be announced at 12:00:01 PM CST on February 6, 2012 via Instagram and Facebook. The second winner (1) will be announced at 12:00:01 PM CST on April 6, 2012 via Instagram and Facebook. Each winner will have 24 hours to accept via Instagram or Facebook or a new winner will be drawn. Coordination of iPhone 5 shipment will be solidified after winner(s) accepts.

The Instagram contest winners (2) will be selected by a panel of judges based on the following criteria: photo creativity and content used to describe memory and image. Decision of the judges is final.

Cambria reserves the right to substitute any prize (or portions thereof) of equal or greater value if any of the prizes (or portions thereof) cannot be awarded as described. Cambria will determine all elements of prizing in its sole discretion. Prizes may not be assigned, transferred, changed or redeemed for cash, except at the sole discretion of Cambria.

PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE EXPRESS OR IMPLIED. CAMBRIA DISCLAIMS ALL AND ANY LIABILITY FOR THE ACTUAL PROVISION, QUALITY OR NATURE OF ANY THIRD PARTY PRODUCT OR SERVICE ACCEPTED BY THE WINNER.

The awarding of any prize is contingent upon full compliance with these Official Rules.

ELIGIBILITY:

The Contest is open only to legal residents of the United States, District of Columbia, and Canada (excluding Puerto Rico and Québec), who reside in the same, and who are 18 years of age or older. Employees, officers, and directors of Cambria, its parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to win prizes in the Contest. This Contest shall only be construed and evaluated according to U.S. law. This contest is void where prohibited by law including, without limitation, Florida, New York, and Rhode Island, Puerto Rico and Québec.

SUBMISSION CONTENT FOR CONTESTS

Entries will be accepted entirely at the discretion of Cambria. Judges will consist of a panel chosen by Cambria. The Instagram contest winners (2) will be selected by a panel of judges based on the following criteria: photo creativity and content used to describe memory and image. Decision of the judges is final.

RELEASE

All winners release Cambria, the prize manufacturers, and each of their parents, subsidiaries, affiliates, officers, directors, agents, and employees from any responsibility or liability in connection with any loss, accident, or death incurred in connection with the use of the prizes won in the Contest. All winners hereby consent to the use of his or her name and/or likeness by Cambria for advertising purposes without additional compensation unless prohibited by law. The verified prize winner’s will be required to sign and return to Cambria, within ten (10) days of receipt, an Affidavit of Eligibility and a Publicity/Liability Release unless prohibited by law. Failure to comply may result in disqualification and the selection of an alternate winner.

TAX CONSEQUENCES

Federal, state, provincial, and local taxes are the responsibility of any winner. The determination of liability for any federal, state, provincial, and local taxes that may arise out of the entrant’s participation in the Contest (including the entrant’s receipt of any prizes), and the payment of any such tax liability, shall be the sole responsibility of the entrant. However, should federal, state, provincial, or local law impose any tax reporting or filing obligations on Cambria arising out of the entrant’s participation in the Contest (including the entrant’s receipt of any prizes), the entrant agrees to timely provide Cambria with any information that is reasonably necessary for Cambria to comply with any such reporting or filing obligations. In addition, should federal, state, provincial, or local law impose any tax withholding obligation on Cambria with respect to entrant’s receipt of any prizes, the entrant agrees to such withholding and shall timely provide any information to Cambria as may be required for Cambria to accomplish such withholding.

GENERAL

Cambria shall be deemed sole interpreter of the Official Rules. By participating, entrants acknowledge and agree to be bound by these Official Rules and that the decisions of Cambria are final. Prices shown are approximate retail prices, and actual prices may vary. Cambria does not make and is not responsible for any warranties (including implied warranties of merchantability or of fitness for a particular purpose) or any guaranty with regard to any prize or portion thereof. Cambria reserves the right, in its sole discretion, to cancel, terminate or suspend the Contest should viruses, bugs, non-authorized human intervention or other causes beyond its control corrupt or affect the administration, security, fairness or proper play of the Contest.
